Gerard’s practice encompasses both general commercial litigation
and financial services disputes. Gerard’s commercial practice
regularly includes advising on the meaning and effect of
contractual terms and boilerplate clauses. His financial services
practice involves acting for life offices, general insurance
companies, trust companies, financial advisers and in disputes
involving networks of IFAs and between product providers and
appointed representatives. Gerard’s recent cases include AXA
Sun Life Services plc v Campbell Martin Ltd [2011] EWCA Civ
133, [2011] 2 Lloyd’s Rep 1, Wincanton Group Ltd v Garbe
Logistics UK 1 SARL [2011] EWHC 905 (Ch) and Carroll v AXA
Sun Life Services Ltd [2010] EWHC 2233 (Merc). He is listed in
Chambers UK 2012 and is described as “outstanding” in this year’s
Legal 500.
Gerard is also Professor of Law at the University of Bristol, where
he teaches courses on contract and commercial law. His books,
The Construction of Contracts – Interpretation, Implication and
Rectification (2nd edition, 2011) and McMeel and Virgo on
Financial Advice and Financial Products – Law and Liability
(2nd looseleaf edition, 2007) are both published by Oxford
University Press. The first edition of The Construction of
Contracts has been cited by courts in England, Australia, New
Zealand, Singapore and Jersey.
